However, in fact, there are still many practices of Nominee agreements based on absolute power of attorney to avoid these legal restrictions in order to disguise ownership of land. The urgency of this research is the importance of studying the legal certainty of nominee agreements based on absolute power of attorney. In this legal research, the normative and prescriptive legal research methods are used. In this legal research, the author uses a statutory regulatory approach, a conceptual approach and a case approach. The author utilizes primary and secondary legal materials. Data collection techniques in this research are carried out through literature studies. In this legal research, the Legal Material Analysis Technique is used with the Syllogism Method, which is a deductive way of thinking that applies logical principles to reach conclusions based on general and specific premises. Nominee agreements based on absolute power of attorney, based on the valid conditions of the agreement in Article 1320 of the Civil Code, have violated the lawful purpose because they disguise the original ownership of the land object and constitute legal smuggling. Instruction of the Minister of Home Affairs Number 14 of 1982 concerning the Prohibition of the Use of Absolute Power of Attorney as a Transfer of Land Rights expressly prohibits the use of absolute power of attorney to transfer or disguise ownership of land rights. In this case, a name borrowing agreement in the transfer of land ownership rights based on an absolute power of attorney, which does not comply with the rules or laws, does not provide legal certainty for the holder of the letter.
Meliana Dyah Pertiwi Adriana Grahani Firdausy Dona Budi Kharisma Copyright (c) 2025 International Journal of Educational Research & Social Sciences https://creativecommons.org/licenses/by/4.0 2025-02-20 2025-02-20 6 1 12 18 10.51601/ijersc.v6i1.938 First to file, Trademark squatting, Fairness, Famous Marks and Law Reform. https://ijersc.org/index.php/go/article/view/953
Trademark protection in Indonesia is regulated under the first to file system, in which rights to a trademark are granted to the party who first registers it at the Directorate General of Intellectual Property (DJKI). Although this system provides legal certainty, its application often leads to injustice, especially in the case of trademark squatting, where a party who is not in good faith registers a mark that has been recognized by another party with the aim of obtaining profits. This research aims to analyze the application of the first to file principle in trademark registration in Indonesia from the perspective of justice, as well as evaluate the legal measures that can be applied to prevent abuse of this system. This research uses the normative juridical method with the analysis of primary, secondary, and tertiary legal materials, as well as John Rawls' theory of justice approach as the basis for policy evaluation. The results show that weaknesses in the definition of good faith, the criteria for famous marks, and the limitation of similarities in essence cause legal uncertainty and open loopholes for abuse. Policy reform is needed through improving the legal substance, strengthening the institutional structure of the DJKI, and simplifying the dispute resolution mechanism through mediation and arbitration. The research conclusions emphasize the importance of more inclusive and equitable legal reforms to protect the rights of legitimate trademark owners, especially small and medium enterprises. With proper legal reform, it is expected that the trademark protection system in Indonesia can become more transparent, effective, and contribute to fair business competition.
Michelle Nathania Copyright (c) 2025 International Journal of Educational Research & Social Sciences https://creativecommons.org/licenses/by/4.0 2025-02-20 2025-02-20 6 1 19 26 10.51601/ijersc.v6i1.953 Investment Risk Analysis Through Portfolio Diversification Using It Based Company’s Stocks and Cryptocurrency https://ijersc.org/index.php/go/article/view/932
Investment is an activity carried out for the purpose of gaining profit in the future by entrusting their assets to several assets such as stocks, securities such as deposits and bonds, property, precious metals, jewelry, foreign currencies, cryptocurrencies, commodities, startup companies, and so on. The problem becomes increasingly complex for those who enter into interfaith marriages. However, the reality of interfaith marriage is a social reality that cannot be avoided. The social and relational nature of humans and the need to meet other people make the potential for interfaith marriages even higher. Humans will increasingly find differences when relating to others who are diverse both in tradition, culture, thought and religion. Catholic teachings and the Code of Canon Law do not require interfaith marriages because it would bring danger to the faith of Catholics. However, the Catholic religion cannot turn away from the social reality where it is not uncommon to find husbands or wives of different religions. Therefore, the Catholic Religion must still consider pastorally interfaith marriages as regulated in Canon 1125 and 1126. In accordance with the provisions of Article 2 paragraph (1) of Law no. 1 of 1974 concerning Marriage states that a valid marriage is a marriage that takes place according to the laws of each religion. A valid marriage must be registered according to the applicable laws and regulations (Article 2 paragraph (2) of the Marriage Law). According to SEMA No. 2 of 2023 concerning Instructions for Judges in Hearing Cases of Applications for Registration of Marriages Between People of Different Religions and Beliefs in number 2 it is stated that the court does not grant requests for registration of marriages between people of different religions. So, if according to one of the religions in Indonesia an interfaith marriage is legal according to the relevant religious law, the court should not refuse to register the marriage at the Population and Civil Registry Service. This research will be carried out using sociological juridical methods using quantitative reasoning.
Rohendi Sahat Martua Marpaung Catharina Dewi Wulansari Copyright (c) 2025 International Journal of Educational Research & Social Sciences https://creativecommons.org/licenses/by/4.0 2025-02-20 2025-02-20 6 1 42 48 10.51601/ijersc.v6i1.931 Dynamics of Consumer Protection Law in the Digital Era: Case Study on E-commerce in Indonesia https://ijersc.org/index.php/go/article/view/957
The digital era has brought significant changes to commercial activities, including the rise of e-commerce as a key pillar of the digital economy in Indonesia.
